No continuous duty to monitor building permits
The Ontario Court of Appeal (ONCA) in Huether v. Sharpe, 2025 ONCA 140 (ONCA Huether) clarified the scope of municipal liability for building inspections and the operation of Ontario’s ultimate limitation period for related claims. The decision examined whether a municipality formally closing an old building permit could amount to an ongoing omission that would extend the time for property owners to bring a claim for latent defects.
