Local improvement charges: user pay for capital projects in Ontario

A new regulation under Ontario’s Municipal Act, 2001 refines the power for municipalities to share capital costs with those who will benefit from the work. Ontario Regulation 586/06 (Local Improvement Charges – Priority Lien Status) came into force on January 1, 2007. It provides that the costs of virtually any capital projects, commenced after that date, can be shared with properties that abut on the work and/or will be immediately benefited by it.
